DEFINITIONS | Transportation of Package through any mode and shall not be restricted to one mode of transport |
Delivery – Means sender of shipment to the Parties or intimation about the arrival of shipment at the destination | |
Patron – mean and includes consignor, consignee and/or his/her authorized representatives. | |
SPR – “ SPR CARRIERS | |
Freight- Refers to the fundamental transportation cost associated with shipping goods, encompassing the charges for the transportation itself. It does not include additional components such as taxes and other levies that may be applicable. | |
NCV – means No Commercial Value as declared by the PATRON |
CONTRACT | THE DOCKET IS A CONTRACT BETWEEN SPR CARRIERS AND PATRON |
DOCUMENTATION | a) Proper and completed documentation by the customer is compulsory required along with accurate details of the shipper/receiver’s name, address, telephone Nos, email-id and forms, waybills, invoices etc. as per the statutory requirements. |
b) SPR CARRIERS shall not be made responsible /liable in case of any deficiency in the documents/statutory requirements and no claim or grievance of any nature shall be entertained. | |
c) Customer hereby undertake to make good the loss to SPR CARRIERS in case their shipment(s) cause damages to other shipment(s) loaded in the vehicle due to inherent nature and which is wrongly declared by the customer OR in case of seizure by any government authority due to improper and incomplete documentation as a result other shipment (s) also get delayed resulting in a loss to SPR CARRIERS. | |
d) SPR CARRIERS shall not be liable for any kind of damages to the goods caused due to improper and defective packaging of goods. | |
SAID TO CONTAIN BASIS | All the consignment shall be booked on “said to contain basis” i.e. SPR CARRIERS shall be under no obligation to verify the description and contents of the shipment declared by the PATRON on the docket/Invoice and as such the PATRON shall undertake and ensure to make correct and factual declaration on the docket/Airway bill. However, SPR CARRIERS reserve the right to inspect and/or refuse booking of shipment not conforming to these terms and condition, only after duly informing PATRON regarding the reasons for such inspection and/or refusal and after receiving the confirmation from PATRON. PATRON shall not book, handover any shipment consisting of prohibited, restricted or dangerous products and SPR CARRIERS shall not be liable for any such shipment. PATRON indemnified and would keep indemnified SPR CARRIERS, its Partners and employees against all claims, losses, charges and expenses incurred by SPR CARRIERS due to any banned, restricted or dangerous items entering in to the network of the SPR CARRIERS due to any omission or commission of PATRON. |
ACCEPTANCE OF TERMS AND CONDITIONS | By giving us your shipment you accept our terms and conditions set out in the consignment note and/or the contract of carriage and/or the contract for the performance of other services on behalf of yourself and/or anyone else who has an interest in the shipment or the performance of other services irrespective of whether you have signed the front of our consignment note or not. Our terms and conditions also cover and can be invoked by anyone we use or sub-contract to collect, transport, deliver your shipment or perform other services as well as our employees, directors and agents. Only one of our authorized officers may agree to a variation of these terms and conditions in writing. When you give us the shipment with oral or written instructions that conflict with our terms and conditions we shall not be bound by such instructions. |
LIMITATION OF LIABILITY | a.) In case of loss, theft, damage and mishandling of booked consignment maximum liability of the Company shall not be exceeding to the sum equivalent to 10 times of freight charges for un-insured documents and 5 times of freight charges for un-Insured parcels (below Rs.5000/-) or the value of the consignment mentioned on the docket whichever is less. |
b) All the high value shipment (above Rupees Five Thousand) and Fragile Shipment should be insured by the PATRON while booking, if any such shipment booked uninsured in such cases, in the event of lost/damages or theft of such shipment the Company will not be liable at all to reimburse to the customer. | |
MODE OF TRANSPORT | The entity or individual is authorized or entitled to utilize any mode of transportation and select any route for the purpose of transporting goods or products. |
NON-NEGOTIABLE | The SPR CARRIERS Waybill/ Consignment Note is non-negotiable and the PATRON acknowledges that it has been prepared by the PATRON or by SPR CARRIERS on behalf of the PATRON. |
FOV (Freight on Value) CHARGES | The company shall collect a parcel valuation charge of an additional 0.4% on top of the freight charges from customers at the time of booking. |
INSURANCE | SPR CARRIERS does not provide any insurance cover of the shipments, hence we advise the customer to insure the goods handed over to SPR CARRIERS for transportation under the PATRON insurance. In the event of any loss, damage and theft SPR CARRIERS shall provide only COF (Certificate of Facts) on request so as to enable the PATRON to claim their loss from the insurance Company. |
PAYMENTS | If the parties fail to take delivery of the shipment for any reason whatsoever, SPR CARRIERS shall generate a bill to the parties for transportation and other charges as per the terms mentioned in this docket. The parties shall be responsible for paying all dues owed to SPR CARRIERS at the original booking station or any other designated station. |
In the event that the PATRON refuses to accept the goods, upon receiving written consent and advance payment, the goods will be rebooked from the destination back to the original booking station. | |
STATUTORY PAYMENTS | a) The customers are solely responsible for all payments if any, levied by the government or any statutory body etc. Such as GST or any other tax levied from time to time. |
b)GST will be charged on the total amount of the freight, including all other charges, in accordance with the rules applicable. The payment of Goods and Services Tax (GST) is mandatory as per the regulations enforced by the relevant authority at any given time. | |
RIGHT TO ENTRUST | The company retains the right to assign the goods to another carrier. In such cases, the company shall not be held responsible for any delays, damages, or losses that may occur during transit through the assigned carrier or due to circumstances beyond our control, including acts of God or man-made calamities. |
LIEN | SPR CARRIERS shall have a general lien over all the consignments of the customer towards any dues payable to GSPLTPL by the customer. |
CLAIMS | a) No claim shall be entertained by the SPR CARRIERS for any loss or shortage/damage/non-delivery/breakage/leakages/pilferage etc. of the consignment unless a written claim is lodged within 2 days from the date of docket, subject to remarks on the proof of delivery. |
b) SPR CARRIERS shall not entertain any claims arising due to delay in delivery of consignment for any reason. | |
DEMURRAGE | a)In case, party fails to take delivery of the shipment within 72 hours from the date of tendering the shipment for delivery, a Demurrage/warehouse charges of 0.1% of the invoice value or Rs 0.25 paise per kg per day or Rs 125/- per day whichever is higher will be charged or such rates may be fixed by SPR CARRIERS from time to time. |
b) We will not be liable for any loss of income, loss of profits, loss of markets, loss of reputation, loss of customers, loss of use, loss of an opportunity even if we had knowledge that such damages or loss might arise or for any indirect, incidental, special or consequential damages or loss howsoever arising including without limitation breach of contract, negligence, willful act or default. | |
c) We are not liable if we do not fulfill any obligations towards you at all as a result of Circumstances beyond our control such as (but not limited to): a) Acts of god including earthquakes, cyclones, storms, flooding, fire, disease, fog, snow or frost or other natural calamities or disasters; b) Force mature including (but not limited to) war, accidents, acts of public enemies, strikes, embargoes, peril, local disputes or civil commotions etc. | |
CHANGE OF ADDRESS | Subsequent to booking of a consignment if the PATRON makes any changes in the address or any other changes, additional charges shall be levied as a result of such a change, as decided by the company. |
ODA | Out of Delivery Area (ODA) are those far off factors where SPR CARRIERS has to arrange special vehicles for delivery. The charges for these shall be in addition to the Freight Charges. The transit Time for these locations shall be in addition to the Transit Schedule/Assured Date of Delivery notified by SPR CARRIERS from time to time. |
RETURN TO ORIGIN(RTO) | If the customer/PATRON do not take delivery of the shipment for any reason whatsoever. SPR CARRIERS shall intimate to the customer/PATRON and upon request of the PATRON SPR CARRIERS return the shipment and raise the bills on the PATRON towards the transportation and other charges including transport charges in accordance with the terms of the contract and the customer shall be liable to pay all dues payable to SPR CARRIERS whether at the original booking station or elsewhere as notified by SPR CARRIERS. |
Where the dox or Non-dox booked unknowingly for the area which comes under NSA (No Service Area) i.e. beyond the network of SPR CARRIERS in such event the said shipment shall be returned to the party/PATRON. In case of NSA service the Maximum Liability of the Company’s shall be limited up to return of freight amount only. | |
FREIGHT REFUND | The refund of freight may be considered under the circumstances of Force Majeure, which includes events such as strikes, bandhs, elections, rains, floods, accidents, festivals, and other natural calamities like earthquakes, tsunamis. Additionally, it also includes situations like lockdowns, pandemics, and any other events beyond the control of AakaashXpress, including routine and/or sudden inspections conducted by authorities of relevant departments such as GST, Customs, Gold Control, NDPS, Municipal, RTA, and any other competent authorities responsible for inspecting goods and vehicles. These factors are beyond the control of AakaashXpress. |
CANCELLATION POLICY | |
A 10% charge is applicable before pickup. | |
A 30% charge is applicable at the time of pick up. | |
Cancellation is not permitted after pick up. | |
LAW AND JURISDICTION | This contract shall be governed and interpreted in accordance with the laws of India. All disputes and claims arising from this contract are subject to the exclusive and irrevocable jurisdiction of the courts in Hyderabad. No other court shall have jurisdiction over such matters. |
RIGHT TO CHANGE | The Company reserves the right to change the clauses mentioned in the terms and conditions without any prior notice. |
ARBITRATION | In the event of any dispute or difference arising between the parties and SPR CARRIERS during the term of this agreement, its termination, or after its termination, the matter shall be referred to a sole arbitrator. The arbitrator will be appointed mutually by the parties from a list of arbitrators provided by SPR CARRIERS , following the fast track procedure governed by the provisions of the Arbitration & Conciliation Act 1996 and Arbitration & Conciliation (Amendment) Act 2015, or any statutory amendments thereof. The arbitration proceedings will take place in Hyderabad, Telangana, and will be conducted in the English language. The arbitrator’s award will be final and binding on the parties. The customer shall bear the cost of the arbitral proceedings, including the enforcement of the award and any interim relief granted. |
SPECIAL ATTENTION TO THE PARTIES | In addition to the clauses mentioned in this document, the remaining terms and conditions can be found on the web portal of www.aakashxpress.in, which is freely accessible to all concerned and binding. Despite the accessibility of the company’s web portal to all parties involved, the terms and conditions specified therein shall be binding upon the parties. |
